Impartiality and integrity of the Danish FSA

§ 12

Employees of the Danish FSA may participate in professional meetings and seminars hosted by undertakings which are under supervision, financial organisations, suppliers, lawyers, auditors etc. Employees shall inform the Administrative Director about their participation in advance.


 

§ 13

(1) Employees of the Danish FSA may not participate in purely social events offered by undertakings which are under supervision, financial organisations, suppliers, lawyers, auditors etc.


(2) In special cases, the Danish FSA may grant exemptions from subsection (1). An application for exemption shall be submitted to the Administrative Director. An application for exemption shall contain all relevant information about the event and the reason for participating.


(3) The executive management may participate in representative tasks to the extent appropriate. Matters of doubt about participation of the executive management shall be decided by the Director General.


 

§ 14

(1) In connection with inspections, the inspectors may receive ordinary lunch if such is offered to them. In connection with inspections with overnight stays, the inspectors may receive one dinner with the undertaking, if it is deemed impolite to reject the invitation, and if the dinner is used to inform said undertaking about the Danish FSA in general. 


(2) The dinner shall subsequently be reported to the Administrative Director.


 

§ 15

(1) Employees of the Danish FSA may not, as part of their employment with the Danish FSA, receive personal gifts or other services from undertakings which are under supervision, financial organisations, suppliers, lawyers, auditors etc. “Gifts” shall mean all services of financial value, including also allocation of a flat.


(2) Recipients may keep gifts of a special nature received in connection with special events, such as appointments, round birthdays and anniversaries.


(3)  In cases where it would seem impolite to reject a gift, the gift shall be handed over to the Administrative Director. Such gifts shall then be used as part of the staff policy of the Danish FSA.


(4) The recipient may keep gifts of a trivial value, such as a pen. Cases of doubt shall be decided by the Administrative Director. 


 

§ 16

(1) Employees of the Danish FSA shall not be members of the board of management, the board of directors, the shareholder committee, or be employed in undertakings which are under supervision by the Danish FSA or in the organisations of such undertakings, cf. section 356 of the Financial Business Act.


(2) Isolated engagements, such as teaching, with undertakings which are under supervision, financial organisations, suppliers, lawyers, auditors etc. shall be approved before an agreement can be made. The application shall be submitted to the Administrative Director. The application shall include a time and date for the engagement, the purpose of it, with whom the agreement is made, as well as the size of any fee.


(3) If an employee has an engagement, cf. subsection (2), the employee cannot at the same time receive a salary from Danish FSA. The application under subsection (2) shall, in such cases, include information about how the time spent on the engagement is being registered.


(4) If an employee gives a presentation or similar on behalf of the Danish FSA without receiving a fee, the employee may receive a token of appreciation, e.g. some bottles of wine. If such token of appreciation was not indicated in the application, cf. subsection (2), it shall be notified afterwards.


 

§ 17

Teaching and other second jobs shall take place during the employee’s free time. If the teaching or second job raises doubt about the legal capacity of the employee in relation to the employee’s performance of his job with the Danish FSA or in any other way have significance to the Danish FSA, the employee shall obtain written permission before an agreement can be made. Teaching and second jobs may not be of significance in their scope. An application concerning teaching and second jobs shall be made to the Administrative Director.
